When property is purchased in Texas, who is responsible to request and complete a survey of the land?

When land is sold ANYWHERE in the US, a title search is usually required. If a mortgage is involved, the lender ALWAYS requires title insurance. The company issuing the title insurance normally conducts a survey as part the title search before issuing the policy. That said, ALL terms of the sale, INCLUDING any survey and who pays for it, should be WRITTEN in the contract.

The person responsibile for selling the land. The cost of the survey may be either paid by the seller or split between the seller and buyer.
Reply:It depends on a lot of things, most of all, what the Contract says.





A Buyer could require the Seller to provide a Survey, but most Seller's would refuse if it isn't required by law, which it isn't in most states.





You get a "legal description" of the land, and the Seller guarantees it is correct. If you don't believe them, do the research.
